The sudden and immense impact of the COVID-19 pandemic is unprecedented and has forced new additional rules and expanded interpretations of existing rules for the workplace. Knowing the difference between appropriate employee discipline and retaliation is especially important to cannabis employers because employee rights violations can negatively impact your cannabis license. Experts representing DFEH, ALRB, and Cal/OSHA will answer questions on issues related to reopening, employee rights, employer responsibilities, and employer liabilities. Agency panel discussion will provide critical information to employers regarding returning to work and related concerns for employers during the changing expectations around COVID-19.

    • DFEH’s guidance on sensitive issues such as whether an employer may send an employee home if they are showing symptoms of COVID-19, whether during a pandemic an employer may ask an employee why they have been absent if they suspect its for a medical reason, whether an employer may reveal if an employee is quarantined and others. 
    • Guidelines issued by Cal/OSHA for the Implementation of an Effective Injury and Illness Prevention Program
    • Restrictions on unsafe employee behavior and enforcement of discriminatory employer behavior, for the protections for employees against retaliation for standing up for their rights, do not change.
